Today the Senate Judiciary Committee voted out of committee the nomination of Judge Sonia Sotomayor to the United States Supreme Court. A full Senate vote is expected within the next couple of weeks. Call your Senators today and urge them to oppose this dangerous nomination. The Capitol switchboard number is (202) 224-3121.
As expected, the committee vote was along party lines, except for Senator Lindsay Graham (R-South Carolina) who decided to go against his constituents and vote to support her nomination. A judge who believes she reaches better conclusions than other judges because of her race and gender does not belongs at the Supreme Court. Though Sotomayor tried to say all the right things at the public hearings, in written questions she has already gone back on her word. Her statements on the use on foreign law illustrate:
Before being nominated Judge Sotomayor said:
“I share more the ideas of Justice Ginsburg … in believing that unless American courts are more open to discussing the ideas raised by foreign cases, and by international cases, that we are going to lose influence in the world.”
During her “conversion” at the hearings, she emphatically said:
“I will not use foreign law to interpret the Constitution or American statutes.”
Then in written questions after the hearings Judge Sotomayor said:
“In limited circumstances, decisions of foreign courts can be a source of ideas informing our understanding of our own constitutional rights.”
Judge Sotomayor’s chameleon-like performances cannot give confidence for any senator to support her for a lifetime appointment to the highest court of the land.
